Visitors or users or others who are repeat infringers of intellectual property rights will have their privileges to use the Website revoked. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnification and limitation of liability.

8. DISCLAIMER AND LIMITATION OF LIABILITY

Except as required by applicable consumer protection law, Eje-Design shall not be liable for any errors or omissions in this information or for any direct, indirect, incidental, special or consequential loss or damage resulting from your use or misuse of or reliance on this information. To the fullest extent permitted by law, Eje-Design shall not be liable for any loss arising out of or in connection with the use of the Website.

The Website, including without limitation all services, content, functions and materials is provided "as is" or "as is", without warranty of any kind, express or implied and without limitation any representation, warranty or condition regarding the information, data, data processing services, availability, or uninterrupted access, any warranty regarding the availability, accuracy, usefulness or content of the information, and any warranty of title, offer to sell, availability, non-infringement, merchantability or fitness of the products or information for a particular purpose. We hereby disclaim all express and implied representations, warranties and conditions. Eje-Design will warrant that the Website or the services, content, functions or materials contained therein will be timely, secure, uninterrupted or error-free, or that defects will be corrected. Eje-Design will not guarantee that the Website will meet the requirements of the visitor or the User or any other person. Eje-Design will not assume any responsibility and cannot be held responsible for any damage or virus, worms, Trojan horses or other harmful elements that may infect your computer equipment or any other property, following your access or navigation on the Website or the downloading of any content, data, text, image, video from the Website. In the event of dissatisfaction with the Website, your only recourse is to stop using the Website.

This provision does not apply to residents of Quebec, to whom the Quebec Consumer Protection Act applies. The provisions of this Disclaimer and Limitation of Civil Liability do not apply to consumers located in the State of New Jersey (United States of America).

9. COMPENSATION

You agree to defend, indemnify and hold harmless Eje-Design, its affiliates, and their directors, officers, employees and agents, from and against any and all claims, liabilities, expenses and costs, including reasonable legal fees, arising in any way from your use of the Website, your posting or transmission of any content, information, software or other materials through the Website, or your violation of law or these Terms of Use, except in the case of Eje-Design's gross negligence or willful default. Eje-Design reserves the right to assume the exclusive defense and control, at its own expense, of any matter otherwise subject to your indemnification, and in such event, you agree to cooperate with Eje-Design in its defense of any such claim.

10. PROHIBITED ACTIVITIES

The following activities are strictly prohibited:

Any automated indexing, screen scraping, data mining, harvesting of email addresses, wireless addresses or other personal contact or data, or any other automatic means to access, log in to or register with the Site or for any service or feature offered on or through the Site, or to obtain lists of users or obtain or access any other information or feature on, from or through the Website or the services offered on or through the Site, including, but not limited to, any information on any server or database connected to the Site or the services offered on or through the Website;
Any attempt to gain or attempt to gain unauthorized access to computer systems, content, information or any other services available on or through the Site by any means;
Any use of the Website or the services made available on or through the Website in any manner with the intention of interrupting, damaging, disabling, overloading, or otherwise impairing the Website or these services, or of harming a third party's use and enjoyment of the Website, including by sending mass unsolicited messages or flooding servers with requests;

You further agree that you are not permitted to attempt or encourage or support anyone else's attempt to circumvent, decompile, decrypt, or otherwise alter or interfere with the Website and its content as made, or make any prohibited use thereof. You are not permitted to obtain or attempt to obtain any content or information through any means not intentionally made publicly available or provided for through the Website.

You are also prohibited from modifying the content or appearance of the Website, knowingly introducing viruses, Trojan horses, worms, web bombs or any other material that is malicious or technologically harmful. You are also strictly prohibited from attempting to gain unauthorized access to our Website, the server on which the Website is stored or any server, computer or database connected to the Website. Furthermore, you must not attack our Site via a denial-of-service attack or a distributed denial-of-service attack.

11. PRICES

The prices of the products are indicated on the Website in Euro and include VAT, sales taxes or other applicable taxes. These prices do not include delivery costs which will be added to the price of the Product and will be communicated to you during the order process and before the validation of your order. These prices do not include any customs duties or local taxes in the country of delivery of the Product(s). These duties or taxes must be paid by the Customer.

EJE DESIGN uses its best efforts to ensure that all prices displayed on the Website are correct. However, it may happen that an error occurs and the prices of the Products are not correctly displayed (incorrect price or typographical error in the price indicated). If this were the case, We would cancel your order and the Contract between us would be cancelled.

EJE DESIGN reserves the right to modify the price of the Products at any time and without notice. These modifications will not apply to Products for which You have already placed and confirmed the order.

12. LEGAL FORUM

Unless otherwise expressly provided, the laws of France (without regard to conflicts of law) govern all matters arising out of or relating to these Terms of Use and the other Site Policies, including without limitation their validity, interpretation, construction, effectiveness and enforcement. Unless otherwise expressly provided, all legal proceedings arising out of or relating to these Terms of Use and the other Site Policies shall be brought exclusively in the courts of Paris, France.

This provision does not apply to residents of Quebec, to whom the Quebec Consumer Protection Act applies.
